By using any of Anido Creatives’ products or services, including hosting, website design, website updates, content writing, SEO, and marketing services or tools, you agree to be bound by the following Terms and Conditions. Placing an order through any method such as email, online form, phone call, or in-person meeting also indicates your acceptance of these Terms of Service.

Anido Creatives may update or revise these terms from time to time with written notice provided 10 to 15 days in advance. Any new features, tools, or resources that improve or expand the existing services will also be covered under these terms. Continued use of our services after any changes means you accept the updated terms.

Any violation of these terms may result in the suspension or termination of your account. You acknowledge that you are using our services at your own risk.

SERVICE TERMS

You must be at least 18 years old to use the Service.
The Service must be used by a human. Automated or scripted access is not permitted.
You must have the legal authority to act on behalf of your business, organization, or entity in matters related to its website and other digital assets.
You are responsible for maintaining the security of your account credentials, including your username and password.
You are fully responsible for all content and activity under your account. This includes any changes made to your website by others acting on your behalf.
You may not use the Service for any unlawful or unauthorized purpose. Your use of the Service must comply with all applicable laws, including copyright and intellectual property regulations.
By using the Service, you grant Anido Creatives the right to place a small credit link on your website. This typically appears in the footer as “Site by ANIDO” or “Powered by ANIDO” near the copyright statement.

WEBSITE PLANS

All Website plans include the following features:

Customization of a pre-designed template, which includes updating fonts, colors, images, logo, and making simple layout adjustments. All changes are subject to your approval. A separate quote applies if a fully custom design is requested.
A user-friendly Content Management System, typically WordPress, that allows you to manage and update your website content.
Unlimited content edits and updates to existing pages, unless service is declined under the terms outlined in the refusal of service policy.
Monitored website hosting with weekly backups and essential software updates to maintain performance and reliability.
Continuous website security and system maintenance to help protect your site from vulnerabilities.
One-time setup of a Google Analytics property to enable traffic monitoring and insights.
On-page SEO, including writing page titles and meta descriptions, optimizing content for search engine visibility, and submitting your sitemap to Google for indexing.

STARTER SITE Plan

Starter plans include all “Included” features listed above PLUS the following features:

3 pages (Homepage, About, Contact).
1 hour of edits per month.

PRO SITE Plan

Pro Site plans include all “Included” features listed above PLUS the following features:

4 pages (Homepage, About, Blog, Contact).
2 hours of edits per month.
Simple Blog / News section that doesn’t require additional custom development or design.

PREMIUM SITE Plan

Premium Site plans include all “Included” features listed above PLUS the following features:

8 pages (everything in Pro Site + 4 additional pages)
Unlimited ongoing content edits.
Dynamic Blog / News section that doesn’t require additional custom development or design

UNLIMITED ONGOING CONTENT EDITS

Our Unlimited Content Edits Plan includes any task that typically takes 30 minutes or less and can be completed within the WordPress admin dashboard.

Examples of covered tasks include:

Adding or updating content on blog posts or pages
Editing navigation menus and widgets
Installing and activating plugins
Adjusting basic page layout settings
And many other small updates

For more complex issues, our team is happy to troubleshoot and provide recommendations on the best solutions based on your needs.

Below is a more detailed list of the most common tasks our support team handles around the clock.

Content Edits:

Publishing blog posts and new pages from provided Word or Text documents
Adding/Removing/Editing text on posts, pages, products, etc.
Uploading provided JPG and PNG images and adding to pages
Cropping/Resizing images within the WP Dashboard
Adding provided keywords, titles, snippets, etc
Adding/Removing/Editing menu items
Configuring popups, notification bars, and slide-in features based on provided text, images, and examples
Create image galleries
Edit page slugs
Adding/Removing/Editing users
Upload PDFs
Adjust widgets

Settings Adjustments:

Updating theme options
Adding redirects
Add/Remove/Edit form fields
Edit templates made from visual editors
Installing simple plugins from the WordPress repository (i.e. “Duplicate Post” or “WordPress Zero Spam”)

We can also take care of the following requests, but they may take a bit longer than our usual turnaround time:

Custom CSS / JS
Performing search and replaces
Adding code snippets through WP hooks
Installing more complex plugins (i.e. a caching plugin or free WooCommerce add-on)
Performance / Page-speed related adjustments based on GT Metrix reports
Minor troubleshooting involving plugin and theme compatibility
Installing tracking codes (i.e. Google Analytics)
Testing contact forms and checkout workflows

TURNAROUND TIMES

Turnaround times for Ongoing Content Edits are as follows:

Emergency Fixes, which include any website issue that is hindering the client from doing business (ex. site down, functionality not working, etc.), will be completed within 24 hours.
General Revisions, which include any other updates or revisions that aren’t otherwise categorized, will be completed within 3 business days.
New Page Additions will be completed within 10 business days.

PAYMENT, REFUNDS, AND OWNERSHIP

A valid credit or debit card is required to activate and use the Service.
The Service operates on a subscription basis and is billed monthly.
If you have signed up for a website plan with a 12-month service agreement, monthly billing will continue for the full duration of the agreement. This remains in effect regardless of service usage or cancellation requests, as it helps cover the upfront cost of website design and development.
For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle.

Once you have completed the 12-month service agreement, you will gain full ownership of your website, all website content, and any related design assets. Upon request, Anido Creatives will provide a complete backup of your website and the original logo files. Please note that after the agreement ends and the final files are delivered, Anido Creatives is not responsible for reinstalling, maintaining, or providing technical support for your website or assets.
All fees are exclusive of any taxes, levies, or duties imposed by local or international tax authorities. You are solely responsible for covering these charges.

CANCELLATION AND TERMINATION OF THE SERVICE

Anido Creatives reserves the right to suspend or terminate your account at any time and deny access to any current or future services. This includes the right to refuse service, as outlined in the “Right to Refuse Service” section below.

You are solely responsible for properly canceling your account. You may cancel at any time; however, if you are subscribed to a website plan or add-on with a 12-month service agreement, billing will continue through the remainder of the agreement term. This policy helps cover the initial costs of design, development, and any applicable add-ons.

If you choose to cancel your subscription, you will not be eligible to repurchase or reactivate any maintenance services for the canceled website for a period of six months, unless you have completed the full 12-month agreement and your account is fully paid. This restriction exists due to the significant cost involved in setting up and maintaining hosting and ongoing support services for each site.

INTELLECTUAL PROPERTY

By hiring Anido Creatives to design your website or other creative assets, you acknowledge and agree that this engagement is considered a work-for-hire arrangement. Full ownership and intellectual property rights for all deliverables created by Anido Creatives will be transferred to you upon completion of the 12-month service agreement, unless otherwise specified in writing.

This clause ensures that Anido Creatives is fairly compensated for the time, resources, and creative work invested in developing the requested materials.

CHANGES TO THE SERVICE AND PRICES

Anido Creatives reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice if payment is not received within 30 days of monthly due date or invoice. Service prices, including but not limited to monthly subscription fees, are subject to change upon renewal of your 12-month agreement. Any pricing updates will be communicated at least 30 days in advance, either via email or by posting the changes on anidocreatives.com. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

RIGHT TO REFUSE SERVICE

Anido Creatives reserves the right to refuse service or discontinue our business relationship at any time. This may occur if we determine that your website, project scope, or IT needs demand an extraordinary amount of time or resources beyond what was originally agreed upon.

Before terminating services, we will make a reasonable effort to negotiate a revised compensation structure that better reflects the work required. If no agreement is reached, we may proceed with terminating the service and issue any applicable refunds.

In the event of service termination, you will receive full ownership of all completed assets up to the termination date. This may include your logo, website, website content, and other related design elements.

Once services are terminated under these conditions, the original agreement will be voided, and you will no longer be obligated to continue monthly payments or fulfill the remaining terms of the contract. However, if your project remains incomplete at the time of termination, Anido Creatives will not be responsible for finalizing or delivering the remaining work.

WEBSITE DESIGN AND RE-DESIGN

All website plans include the customization of one pre-designed template, unless otherwise stated in writing. Anido Creatives reserves the right to decline service or issue a refund if we determine that your existing website is not eligible for redesign. Ineligibility may be based on factors such as content, platform limitations, or the presence of custom code or integrations that are incompatible with our workflow.

For new designs or redesigns, we reserve the right to choose the most appropriate platform for your website. In most cases, this will be WordPress, as it allows us to efficiently manage updates and gives you the flexibility to add features like blogs and other enhancements.

Once we receive your finalized homepage content and all required materials, we will begin customizing and building your website. When the initial version is ready, we will provide a preview link hosted on our development server. You will have one round of revisions before the site is finalized and launched.

GENERAL CONDITIONS

Your use of the Service is entirely at your own risk. The Service is provided “as is” and “as available.”
Our services are performed by human technicians, not automated systems. While we strive for accuracy, mistakes may occasionally occur.
If you have purchased a Website Plan, billing will continue for the full term of your agreement, regardless of whether you actively use the service or request cancellation. This ensures that the costs of initial design and development are covered.
You acknowledge and agree that we utilize third-party vendors and hosting partners to supply the necessary hardware, software, networking, storage, and related technology required to deliver the Service.
We reserve the right, though we are not obligated, to remove any content or accounts that we determine to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable. This includes violations of intellectual property rights or any other breach of these Terms of Service.
Any form of abuse directed toward Anido Creatives staff, clients, or representatives, including verbal, physical, or written abuse or threats will result in immediate termination of your account.
We are not responsible for ensuring that your website complies with the Americans with Disabilities Act (ADA) or the General Data Protection Regulation (GDPR).
You understand that technical processing and transmission of the Service, including your content, may occur without encryption and may involve (a) transfers over various networks and (b) adjustments to meet technical requirements of connecting devices or systems.

LIMITATION OF WARRANTY

Anido Creatives does not guarantee:

That the Service will be completely uninterrupted, fully secure, or entirely error-free. We do, however, provide 99.9% uptime through our servers.
That the results you obtain from using the Service will be entirely accurate.
That any products, services, or materials obtained through the Service will meet expectations outside the scope of the stated Website Plans.

LIMITATION OF LIABILITY

You agree that Anido Creatives shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, losses related to profit, goodwill, use, data, or other intangible assets. This limitation applies even if we have been advised of the possibility of such damages, and regardless of how they arise, including but not limited to:

Your use or inability to use the Service
The cost of replacing products or services
Unauthorized access to or alteration of your data
Conduct or statements by third parties using the Service
Any other matter related to your use of the Service

ENFORCEMENT AND ENTIRE AGREEMENT

Failure by Anido Creatives to enforce any provision of these Terms shall not constitute a waiver of that provision. These Terms of Service represent the full and binding agreement between you and Anido Creatives and override any previous agreements, including earlier versions of these Terms.

FORCE MAJEURE

Neither party shall be liable for any failure to perform its obligations caused by events beyond its reasonable control. This includes, but is not limited to, fire, weather conditions, accidents, acts of terrorism or war, labor disputes, supply shortages, acts of God, government orders, or any other unforeseen and uncontrollable events.

GOVERNING LAW AND DISPUTE RESOLUTION

Any dispute related to this Agreement must be submitted to binding arbitration in the Philippines, following the rules of the Philippine Institute of Arbitrators. Any action to enforce the outcome of arbitration shall be brought in a court of competent jurisdiction in the Philippines.

This Agreement shall be governed and interpreted in accordance with the laws of the Philippines, without regard to its conflict of laws principles.

If any portion of this Agreement is found to be unenforceable by a court of law, that portion shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

AGREEMENT DETAILS & MAINTENANCE PLANS

Your 12-month agreement begins on the date of purchase. Monthly payments will be automatically charged to the debit or credit card associated with your account, on the same calendar day each month as your initial subscription date.

At the end of your 12-month term, ownership of your website and all associated content will be fully transferred to you. If you choose to cancel your subscription at that time, a backup file of your website will be provided upon request. If no cancellation is submitted, your account will automatically transition to the maintenance plan you selected at the start of your agreement. Available Maintenance Plans include:

Starter Site Maintenance Plan: This option, priced at $150 per month, covers hosting and post-agreement maintenance.

Pro Site and Premium Maintenance Plan: For a fee of $300 per month, this plan encompasses hosting and grants you unlimited post-agreement content edits.

After the initial 12-month agreement, you may cancel your subscription at any time with a 30-day written notice.
